SmartMoney Terms of Use

These terms apply to your use of the SmartMoney mobile app. Please read them with the SmartMoney Privacy Policy, which forms part of these terms.

1. Who we are and accepting these terms

SmartMoney is a product of Lorde Global Holdings (Pty) Ltd, registration number 2020/167081/07 ("we", "us"). By creating an account or using the app you accept these terms. If you do not accept them, do not use the app. You must be 18 or older to use SmartMoney.

2. What SmartMoney is, and is not

SmartMoney helps you understand and organise your South African tax affairs. It runs a tax health diagnosis, tracks tasks and deadlines, estimates figures, keeps business records and invoices, and answers common questions through Sam.

Every figure the app shows is an estimate based on the information you enter. The app does not give financial, legal or tax advice, does not file returns with SARS for you, and nothing in it is a binding assessment. Your filing obligations remain your own. For a binding view of your tax position, consult a registered tax practitioner.

Sam answers from approved general information and cannot see or assess your full tax position.

3. Your account

Give accurate information when you register and keep your sign-in details safe. You are responsible for activity on your account. You can sign in with your email and password, or with your Apple or Google account. You can delete your account at any time from your Profile; deletion permanently erases your information as described in the Privacy Policy.

4. Subscriptions and billing

Some features need a paid plan. Plans are annual subscriptions bought through the Apple App Store or Google Play at the price shown in the app before you buy, which your store shows in your local currency.

5. Practitioner minutes

Paid plans include an allowance of practitioner minutes each subscription year, recorded in your account. Minutes are credits towards professional work by a connected tax practice once the app offers that service; until then they accrue in your account and cannot yet be spent. They have no cash value, cannot be transferred or refunded, and are used only when you choose to use them for a task. Work beyond a task's scoped minutes is quoted by the practice before it starts.

6. Business Suite

If you create invoices or add customers, you are responsible for their accuracy, for your own VAT and tax treatment, and for having a lawful reason to hold your customers' details. Invoices and reports are sent only when you press send, to the addresses you enter.

7. Acceptable use

Do not use the app to break the law, infringe anyone's rights, submit information you know to be false, abuse Sam or other people, or interfere with the app's operation or security. Do not share ID, tax, card or phone numbers with Sam; the app refuses messages that contain long numbers like these. You may not reverse engineer the app except where the law allows it despite this term.

8. Intellectual property

The app, its content and its branding belong to us or our licensors. You keep ownership of the information you enter, and you allow us to process it to provide the service to you, as set out in the Privacy Policy.

9. Availability

We work to keep the app available but cannot promise it will always be uninterrupted or error-free, for example when your connection is offline or during maintenance.

10. Limitation of liability

To the extent the law allows, the app is provided as is, and we are not liable for loss arising from reliance on estimates in the app, missed filing deadlines, or events beyond our reasonable control. Nothing in these terms limits rights you have that cannot be limited under South African law, including under the Consumer Protection Act 68 of 2008 where it applies.

11. Ending or changing the service

We may suspend or close an account that breaks these terms. We may change these terms; material changes will be shown in the app before they take effect, and continuing to use the app afterwards means you accept the change.

12. Governing law and contact

South African law governs these terms and South African courts have jurisdiction over disputes. Questions and complaints: support@getsmartmoney.co.za.
